Data Protection, Privacy and Security

The User's privacy and security is very important to TED. The User understands and agrees that by using the Website, the User consents to the collection, use, and disclosure of the User's information as set forth in TED's Privacy Policy. Please review TED's Privacy Policy carefully. TED uses commercially reasonable measures to protect the security of the User's personal identification information and device's information.

The only personal data to which we shall have access via the Website shall be: (a) those details that the User voluntarily provides us (e.g. when the User signs up and registers for the SIELE Account, we will request personal information such as name and last names, valid identification number from their corresponding country, address, email address, telephone number), and (b) the information we collect when the User contracts and accesses SIELE Services (e.g. we can collect information regarding the SIELE Services the User uses, such as the way he or she has used said services, through installed cookies).

The present data protection section is presided over by compliance with the current legislation regarding protection of personal data and the Law for Information Society Services and Electronic Commerce.

In compliance with that set forth in Organic Law 15/1999, from the 13th of December, on the Protection of Personal Data (hereinafter, the "LOPD" for the Spanish acronym), and its development regulations, TED informs its Users that the data provided through the Website is considered personal data, as well as the data that may be accessed as a consequence of browsing, shall be entered into an automated TED file, with SIELE (Servicio de evaluación y certificación de la Lengua Española) termed responsible for said file, and which is registered in the Spanish Data Protection Agency.

The purpose for processing personal data is to offer and supply Users with SIELE Services for assessment and certification of Spanish Language proficiency and its marketing, which includes: (i) managing all registrations, reservations, purchases or other transactions the User may make within the field of SIELE Services; (ii) managing, maintaining, and controlling the relationship with Users, including carrying out surveys; and (iii) improving SIELE Services in addition to identifying, developing, and offering new products and services that may be of interest to Users, to be able to create statistical analyses of aggregated User data and behavior related to SIELE Services and Website use.

In compliance with Law 34/2002, from the 11th of July, for Information Society Services and Electronic Commerce, (hereinafter, the "LSSICE" from the Spanish acronym), the User expressly authorizes that TED may send and/or offer via any medium, either via electronic marketing communication or the equivalent (such as email, SMS, MMS and similar) and via telephone, all kinds of information regarding products and/or services either from TED, the INSTITUTIONS, and/or third party companies, that may be of interest to the User.

The User expressly authorizes TED to assign its personal data to the Authorized Examination Centers in order for them to send and/or offer, via any medium, either via electronic or any equivalent means (such as e-mail, SMS, MMS and similar) and via telephone, commercial or promotional communications regarding all kind of information related to educational offerings.

The User may revoke consent to receive marketing communication sent by (i) TED, by sending an email to the following address: legal@siele.org. or (ii) Authorized Examination Centers, by addressing directly to them.

In such cases wherein it is necessary to fill out a form or send an email (and click on the send button), doing so will necessarily imply that the User has been informed (in virtue of article 5 of the LOPD) and, where appropriate, has given their consent (in accordance with article 6 LOPD) to the content of the present data protection section.

The Authorized Examination Centers will have access to Users' personal data to verify their identity before doing the exams, and to carry out proper management and development of SIELE Services.

The Users may contact TED with the purpose of freely exercising their rights of access, rectification, cancellation and opposition with regards to the data entered into its files, through communication by email message to the following email address, in the case that the User accesses from the email address that appears in his or her User SIELE Account, with the purpose of ensuring identification.

The User may also exercise their rights to access, rectification, cancellation and opposition in writing addressed to: Telefónica Educación Digital, S.L.U. User Support SIELE, to the following postal addresses, with the following reference on the letter: Exercising ARCO rights (under this notification method, via post, the User must confirm their identity by providing a photocopy of the official identification document):

Legal Process

TED may access, preserve, and share the User's information in response to a legal request, such as a subpoena, warrant, court order, or other legal process) which TED believes (correctly or otherwise) to be valid. TED may notify the User of such process by email, by phone, or in writing. TED may honor any legal process that is served personally, by mail, or facsimile to TED, even if applicable law requires personal delivery at another location.

Access Credentials for SIELE Account

The User agrees not to authorize any other person or entity to use the User's SIELE Account username and password ("Credentials") to access the User's SIELE Account, and the User is solely responsible if he/she does not safeguard his/her SIELE Account Credentials or someone else uses his/her SIELE Account with or without his/her permission. The User is solely responsible for maintaining the security of his/her Credentials and personal identification from which his/her Credentials may be learned.

If the User believes that his/her SIELE Account Credentials have been potentially compromised, contact TED immediately by sending an email to legal@siele.org.

TED is not responsible for the User's failure to comply with this provision, or for any delay in alerting TED to a suspected compromise of your SIELE Account.
